Welcome to Maplable. These Terms of Service ("Terms") govern your access to and use of the Maplable platform, website at maplable.com, and related services (collectively, the "Service") operated by ArtIsInFormation ("Company", "we", "us", or "our").
By creating an account, accessing, or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.
1. Eligibility
You must be at least 18 years old and capable of entering into a binding agreement to use the Service. By using Maplable you represent that you meet this requirement.
2. Account Registration
To access the Service you must create an account with accurate, complete information. You are responsible for:
- Maintaining the confidentiality of your login credentials
- All activity that occurs under your account
- Notifying us immediately of any unauthorized use at support@maplable.com
3. Early Access Program
Maplable is currently in early access. During the early access period:
- Access is granted at our sole discretion and may be limited in seats
- Features, functionality, and availability may change without notice
- The Service is provided "as is" without warranty of uptime or reliability
- We may revoke access at any time for any reason
- No fees are charged during the early access period unless otherwise communicated
4. Acceptable Use
You agree not to:
- Violate any applicable law or regulation
- Upload or transmit malware, viruses, or malicious code
- Attempt to gain unauthorized access to the Service, other users' accounts, or underlying systems
- Scrape, crawl, or use automated means to access the Service without written permission
- Use the Service to harass, abuse, defame, or infringe upon the rights of others
- Reverse engineer, decompile, or disassemble any part of the Service
- Resell, sublicense, or redistribute the Service without written consent
5. Your Content
You retain ownership of all content you create or upload to Maplable ("User Content"), including maps, labels, projects, images, and data files. By uploading User Content you grant us a limited, non-exclusive license to host, store, and display it solely for the purpose of providing the Service to you.
You represent that you have all rights necessary to upload your User Content and that it does not violate any third-party rights.
6. Intellectual Property
The Service, including its design, code, trademarks, logos, and documentation, is the property of ArtIsInFormation and is protected by copyright, trademark, and other intellectual property laws. These Terms do not grant you any right to use our branding without prior written consent.
7. Third-Party Services
Maplable integrates with third-party mapping and data providers (e.g., Cesium, map tile services). Your use of those services is subject to their respective terms. We are not responsible for third-party service availability or content.
8. Fees & Payment
During the early access period and for free users, the Service may have some feature limitations. Use of the World Terrain, Photorealistic 3D Tiles, Moon, and Mars requires a paid Mablable Pro plan or a Cesium Ion API key. Paid plans are available on a per-user basis, pricing and billing terms will be communicated in advance. Payments, if applicable, are processed securely through Stripe. You agree to pay all applicable fees and authorize us to charge your payment method on file.
9. Termination
You may delete your account at any time by contacting support@maplable.com. We may suspend or terminate your account if you violate these Terms or for any other reason at our discretion, with or without notice. Upon termination, your right to use the Service ceases immediately. We may retain de-identified, aggregated data for analytics purposes.
10. Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE. 11. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, ARTISINFORMATION AND ITS OFFICERS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, REVENUE, OR PROFITS, ARISING OUT OF YOUR USE OF THE SERVICE, REGARDLESS OF THE THEORY OF LIABILITY. OUR TOTAL AGGREGATE LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR $100, WHICHEVER IS GREATER.
12. Indemnification
You agree to indemnify and hold harmless ArtIsInFormation from any claims, damages, or expenses arising from your use of the Service, your User Content, or your violation of these Terms.
13. Governing Law
These Terms are governed by the laws of the State of Texas, without regard to conflict-of-law principles. Any disputes arising under these Terms shall be resolved in the state or federal courts located in Travis County, Texas.
14. Changes to These Terms
We may update these Terms from time to time. If we make material changes, we will notify you via email or a prominent notice on the Service. Continued use after changes take effect constitutes acceptance of the revised Terms.
